Terms of Service

These Terms of Service ("Terms") govern your access to and use of breakPoint (the "Service"), operated by BreakpointWagers. By accessing or using the Service, you agree to be bound by these Terms.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

Account

You are responsible for maintaining the security of your account and for all activities that occur under it. You must provide accurate information and notify us promptly of any unauthorized use.

Nature of the Service

breakPoint is an independent informational tool for tennis odds analysis and DraftKings DFS contest tracking. It is not a sportsbook, does not accept or place wagers, and does not guarantee any outcome or profit. Nothing in the Service constitutes betting, financial, or legal advice. You are solely responsible for your own decisions and for complying with the laws of your jurisdiction.

Subscription and billing

The Service is provided on a subscription basis at the price displayed at checkout. Subscriptions automatically renew until canceled. By providing payment information, you authorize us (and our payment processor, Stripe) to charge the applicable fees.

From time to time we may offer trials, discounts, or promotional pricing. Promotional terms apply only as offered and may be modified, suspended, or terminated at our discretion.

Cancellation and refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods. See the Cancellation Policy for details.

Acceptable use

You agree not to:

  • Use the Service in violation of any applicable law or regulation.
  • Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
  • Reverse engineer, scrape, or systematically extract data from the Service.
  • Share your account or use the Service on behalf of others without authorization.
  • Use the Service to harass, harm, or impersonate any person.

Intellectual property

All content, software, and materials provided through the Service are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes consistent with these Terms.

Third-party services and content

The Service may interact with or display data from third-party services (such as sportsbooks, odds providers, and DraftKings). We are not responsible for the availability, accuracy, or content of any third-party services, and your use of them may be subject to their own terms.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify and hold harmless BreakpointWagers and its operators from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

Governing law

These Terms are governed by the laws of the United States and the state in which BreakpointWagers operates, without regard to conflict of law principles. Any dispute arising out of these Terms will be resolved in the courts of competent jurisdiction in that location.

Changes to these Terms

We may modify these Terms from time to time. Material changes will be communicated by posting an updated version with a new effective date or by emailing the address associated with your account. Continued use of the Service after changes take effect indicates acceptance.
